Consultation and Design Agreement

This Consultation and Design Agreement is entered into on [Date] between [Client Name] ("Client") and Dax Art Studio

1. Consultation: The Client agrees to participate in a consultation session with the Studio to discuss the project requirements and design ideas. The Studio agrees to dedicate time and resources to understand the Client's vision and provide creative input during the consultation.

2. Design Development: Following the consultation, Dax Art Studio will develop initial design concepts based on the discussions and requirements outlined by the Client. The Client acknowledges that the design concepts remain the intellectual property of the Studio until a formal agreement for project execution is reached.  In this contract, it is established that each designed piece is exclusive to the client who requests it, while the concept and original design remain the intellectual property of the artist. The client has the option to acquire all rights to use and reproduce the work by paying an additional fee.

3. Important Notes: The perception of a piece of art varies according to each individual, since glass and its colors have their own reactions and characteristics that are not 100% controllable. We want to clarify that this is art, and not everyone interprets it in the same way. manner. These pieces are a creation of the artist, based on his skills and knowledge of the art.  Every piece is handcrafted, and no two pieces are alike.
You may have some little air Bubble on the glass.  May contain recycled material.

4. Agreement Terms: If the Client decides not to proceed with the project after the consultation and receipt of initial design concepts, they agree to compensate the Studio for the time and effort invested in the design development process. The compensation amount will be determined based on the Studio's hourly rate of $75 for design services.

5. Payment Terms: On case of cancelation Payment for design services rendered will be due within 10  days of receipt of the invoice issued by the Studio. Failure to make payment within the specified timeframe may result in additional fees or legal action to recover the owed amount.  

6. Confidentiality: Both parties agree to maintain the confidentiality of any proprietary information shared during the consultation and design development process.

7. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Estate of Florida

8. Entire Agreement: This Agreement constitutes the entire understanding between the parties concerning the subject matter herein and supersedes all prior agreements, whether written or oral.

Subject Matter and Style:

  • Describe the subject matter, theme, and any specific details or elements you want to be included in the artwork.
  • Indicate your preferred colors, size, and medium (e.g., glass, metal).
  • Provide any logo or image we prefer vector files (eps, ai, coel or pdf)

Reference and Inspiration:

  • List any of my prior works that resonate with your vision or are similar to what you like.
  • Attach any photos, blueprints, or reference images of the area or space where the artwork will be displayed for context and inspiration.

Artwork Development:

  • Once we agree on the concept, I will create and refine a preliminary drawing or digital design for your approval.
  • Throughout the production process, I will provide interim photos and updates to keep you informed and involved in the creation of your artwork.

Production Timeline:

  • Idea concept  allow 4-5 days
  • Orders allow 2 to 5 weeks (depend of the design and manufacturing techniques )" for the completion of the commission once the design is approved.
  • As I work on multiple projects simultaneously, this timeframe ensures each commission receives the attention and craftsmanship it deserves.

Full-Service Experience:

  • Rest assured, we offer comprehensive services from initial design consultation to installation.

Payment Terms on Commissions orders:

  • A deposit from 50% to 80% is required to initiate the commission, with the remaining  due upon completion and before shipping.
  • If you are unfamiliar with my pricing for original works, please provide a budget you would like to work within, and I will tailor the design and scope of the project accordingly.

Installation Services:

  • We offer professional installation services for your artwork. Installation charges will be applied once the installation is completed, ensuring the artwork is securely and beautifully displayed in its intended space. 
  •  If the requested work requires installation and that installation requires a permit with the owner of the building or the local government, the client is responsible for making the official request and its costs.
  • Our studio will provide evidence of  Certificate of Insurance (COI) for any installation
